1. Agreement

These Terms & Conditions ("Terms") govern your use of the Hotelkite platform and services provided by Hotelkite Private Limited and Hotelkite Inc (collectively, "Hotelkite"). By accessing or using our services, you agree to be bound by these Terms.

2. Services

Hotelkite provides a cloud-based property management platform including, but not limited to, reservation management, front office operations, channel management, revenue intelligence, guest CRM, and AI-powered automation through KeyIO. Services are provided on a subscription basis.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the platform or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the software
• Resell or redistribute the service without written consent

5. Subscription and Payment

Subscriptions are billed monthly or annually as selected during signup. Prices are subject to change with 30 days' notice. All fees are non-refundable except as described in our Refund Policy. Failure to pay may result in suspension or termination of your account.

6. Data Ownership

You retain ownership of all data you input into the Hotelkite platform. We do not claim ownership of your property data, guest information, or business records. We use your data solely to provide and improve our services as described in our Privacy Policy.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, Hotelkite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of the platform.

9. Termination

Either party may terminate the subscription with 30 days' written notice. Upon termination, your access to the platform will be revoked and your data will be available for export for 30 days, after which it will be deleted.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which the applicable Hotelkite entity operates. Hotelkite Private Limited is governed by the laws of India. Hotelkite Inc is governed by the laws of the State of Delaware, United States.
